Property and Guest Rules

How to be in a Malaya villa: who is responsible, what is needed at check-in, quiet hours, safety, the pool, damage, events and staff.

3.1Lead guest responsibility

The lead guest is responsible for the conduct of all registered guests, visitors, children, and invited service providers connected with the reservation. To the extent permitted by law, the lead guest and responsible adult guests may be held jointly and severally liable for verified damage, unpaid charges, and material violations caused by members of their group.

3.2Check-in requirements

Before entry, Malaya may require:

  • a valid government-issued ID from the lead guest;
  • the final guest list;
  • verified full payment;
  • the security deposit; and
  • completion of the digital waiver and property acknowledgment.

Failure to complete mandatory requirements may delay or prevent check-in without extending the checkout time.

3.3Clean-as-you-go

Malaya generally does not charge a standard cleaning fee. Guests must observe CLAYGO (Clean As You Go), place waste in designated areas, wash or organize used kitchenware as instructed, and leave the property in reasonably orderly condition.

CLAYGO does not require guests to perform professional housekeeping. Excessive mess, stains, waste, prohibited materials, or damage may result in a reasonable documented charge.

3.4Noise and quiet hours

Guests must respect neighbors, onsite staff, subdivision rules, and property-specific quiet hours. The applicable property rule shown in the listing, confirmation, or onsite notice controls. Unless a stricter property or HOA rule applies, quiet hours are observed from 9:00 PM to 7:00 AM.

Karaoke, speakers, shouting, and outdoor activity must be reduced or stopped when required. Repeated or serious violations may result in equipment restriction, penalties, or termination of the stay where proportionate and lawful.

3.5Safety and prohibited conduct

Guests must follow posted pool, balcony, rooftop, kitchen, fire, parking, and emergency instructions. Children and non-swimmers must be actively supervised by a responsible adult.

The following are prohibited unless expressly approved in writing:

  • illegal drugs or unlawful activity;
  • weapons, hazardous materials, fireworks, or open flames;
  • smoking or vaping in non-smoking indoor areas;
  • tampering with CCTV, smoke alarms, locks, routers, safety equipment, or utilities;
  • commercial shoots, ticketed events, suppliers, or large gatherings not included in the booking;
  • pets at a property not designated as pet-friendly; and
  • conduct that threatens guests, staff, neighbors, or property.

Smoking inside the villa is strictly prohibited. A ₱5,000 charge may be imposed for a verified violation to cover deodorizing, additional cleaning, and operational disruption, subject to reasonable documentation and applicable law.

3.6Pools, amenities, and equipment

Amenities must be used for their intended purpose and within posted hours. A private villa may involve inherent risks associated with swimming pools, stairs, balconies, kitchens, electrical appliances, glass fixtures, parking areas, and outdoor spaces. Pool depth, temperature, weather exposure, and operating conditions vary by property. Glassware and unsafe behavior are prohibited near pools.

Unless expressly stated otherwise, no lifeguard is provided. Guests use pools and amenities with reasonable care and at their own risk. Children, elderly guests, non-swimmers, and vulnerable persons must be supervised at all times by a responsible adult. This acknowledgment does not waive liability that cannot legally be excluded, including liability arising from proven gross negligence or willful misconduct.

Temporary interruption of a non-essential amenity will be addressed reasonably based on its duration and effect. It does not automatically entitle a guest to a full refund when the accommodation remains safe and substantially usable.

3.7Damage, loss, and inspections

Guests must promptly report existing damage, accidents, injuries, or equipment problems. Malaya may enter the property with reasonable notice for urgent repairs, safety checks, or suspected serious rule violations. No notice is required in a genuine emergency.

Malaya may charge only reasonable and supportable amounts for guest-caused loss or damage beyond ordinary wear and tear.

Where installed, CCTV cameras are limited to disclosed common and exterior areas for security, safety, and incident investigation. Cameras must not be installed inside bedrooms or bathrooms. Covering, disconnecting, damaging, or otherwise tampering with CCTV or security equipment is prohibited.

3.8Events, visitors, and suppliers

Events, prenup shoots, weddings, team-building activities, catering, styling, and outside suppliers require prior written approval and may require a separate event rate, deposit, permits, or vendor rules. Sleeping capacity and event capacity are different and must not be treated as interchangeable.

3.9Staff interaction and tips

Onsite staff may assist with check-in and approved guest services. Tips are voluntary unless a service charge is clearly disclosed and accepted before purchase. Guests must not ask staff to perform unsafe, unlawful, or unauthorized work.

3.10Removal or termination of stay

Malaya may refuse entry or terminate a stay for fraud, violence, serious safety risks, illegal activity, material property damage, substantial overcrowding, or repeated material rule violations after warning when a warning is appropriate.

Any refund for an unused portion will depend on the circumstances, documented losses, the disclosed cancellation terms, and applicable law. Malaya will not impose a penalty that is disproportionate or prohibited by law.

Rules specific to your villa

These rules apply across the Malaya collection. Each villa’s own page and your booking confirmation carry the details that differ from villa to villa — sleeping and event capacity, the security deposit and any villa-specific fees, quiet hours and subdivision restrictions, pet and smoking rules, parking, pool and amenity restrictions, and event and supplier rules. Where a villa sets its own rule, that rule controls. The guest information guide sent with your confirmation repeats the practical ones: bring your own towels and toiletries, segregate waste, and keep glassware away from the pool.
