The terms that govern your use of the Malaya Villas website, booking pages, guest portal, messaging and payment features.

1.1About these Terms

These Website Terms and Conditions (“Terms”) govern your access to and use of the Malaya Villas website, booking pages, guest portal, messaging tools, payment features, and related online services (collectively, the “Platform”).

The Platform is operated by Marjun Gungob Lopez, a sole proprietor doing business under the DTI-registered business name MALAYA VILLA RENTAL (“Malaya,” “we,” “us,” or “our”). The business name is registered under Business Name No. 7287664, with territorial scope in Laurel, Batangas, Region IV-A (CALABARZON), and is valid from 10 July 2025 to 10 July 2030, subject to continuing compliance with applicable law. Our business address is L4A Kabangaan Road, Iruhin West, Tagaytay City, Cavite, Philippines.

By accessing the Platform, creating an account, making or paying for a reservation, or checking the acceptance box, you confirm that you have read, understood, and agreed to these Terms and the policies incorporated into them.

The policies incorporated into these Terms are the Booking, Payment, Cancellation, and Refund Policy, the Property and Guest Rules, the Privacy Notice and the Cookie Notice.

If you make a reservation for other guests, you represent that you are authorized to accept these Terms for the group and that you will provide the applicable rules to every guest.

1.2Eligibility and account responsibility

You must be at least 18 years old and legally capable of entering into a contract to make a reservation. You must provide accurate, current, and complete information.

You are responsible for:

  • keeping your login credentials and one-time passwords confidential;
  • all authorized activity performed through your account;
  • immediately notifying us of suspected unauthorized access; and
  • ensuring the lead guest and all accompanying guests comply with these Terms.

We may request valid identification, contact information, proof of payment, or other reasonable verification before confirming or allowing a stay.

1.3Platform role and property information

The Platform allows users to view properties, request or make reservations, submit payments, communicate with Malaya, sign waivers, and manage stay-related requests.

We aim to keep listings, photos, rates, availability, amenities, and property descriptions accurate. Minor changes caused by maintenance, replacements, weather, safety requirements, or circumstances outside our reasonable control may occur. Material changes affecting the essential purpose of a confirmed booking will be communicated to the lead guest.

1.4Acceptable use

You must not:

  • use the Platform for fraud, unlawful activity, or unauthorized commercial purposes;
  • submit false identities, altered receipts, fraudulent payment confirmations, or misleading information;
  • attempt to bypass security, access controls, pricing rules, or booking restrictions;
  • scrape, copy, reverse engineer, disrupt, or overload the Platform;
  • upload malware or content that violates another person’s rights;
  • impersonate another person or falsely claim authority to act for them; or
  • misuse guest, staff, owner, contractor, or property information obtained through the Platform.

We may suspend access, cancel a fraudulent or unauthorized transaction, preserve relevant evidence, and report suspected unlawful activity to the appropriate authorities, subject to applicable law.

1.5Electronic communications and signatures

You consent to receive transactional notices electronically through email, SMS, the Platform, or supported messaging channels. These may include reservation confirmations, payment reminders, check-in instructions, safety notices, policy updates affecting your booking, and service messages.

Electronic acceptance, digital signatures, uploaded documents, and Platform records may be used as evidence of your instructions and agreement, to the extent permitted by law.

Marketing messages will be sent only when a lawful basis exists. You may opt out of non-essential marketing without affecting transactional messages necessary to service an active booking.

1.6Intellectual property

The Platform, Malaya brand assets, original photographs, copy, graphics, software, and other original materials are owned by or licensed to Malaya. You may use them only for personal evaluation and management of your reservation. No ownership right is transferred to you.

You may not reproduce or commercially use these materials without prior written permission, except as allowed by law.

1.7Third-party services

The Platform may use or link to payment processors, identity providers, calendar services, maps, social login providers, and other third-party services. Their separate terms and privacy practices may apply. Malaya does not control an independent third party’s systems, but we remain responsible for our own obligations under applicable law.

1.8Service availability

We may perform maintenance, update features, or temporarily restrict parts of the Platform for security or operational reasons. We do not guarantee uninterrupted or error-free access. This clause does not remove rights that cannot lawfully be excluded.

1.9Disclaimer and limitation of liability

To the maximum extent permitted by Philippine law, Malaya is not liable for indirect, incidental, or consequential loss arising from use of the Platform or a stay when such loss was not directly caused by Malaya’s breach, negligence, or willful misconduct.

Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded, including liability for fraud, gross negligence, willful misconduct, or obligations imposed by applicable consumer and data-protection laws.

Guests remain responsible for personal belongings, except where loss or damage is directly caused by Malaya or where applicable law provides otherwise.

1.10Indemnity

To the extent permitted by law, you agree to be responsible for direct losses, claims, fines, repair costs, or third-party demands caused by your unlawful conduct, material breach of these Terms, or the conduct of guests or visitors under your reservation. Malaya must take reasonable steps to minimize its loss and provide reasonable supporting documentation for a charge.

1.11Changes to these Terms

We may update these Terms prospectively. The version accepted at the time of booking will generally govern that reservation, unless a change is required by law, relates to safety, or is expressly accepted by you. Material changes will be communicated through an appropriate channel.

1.12Governing law and dispute resolution

These Terms are governed by the laws of the Republic of the Philippines.

Before filing a formal claim, you and Malaya agree to try in good faith to resolve the issue through Customer Support. This does not prevent either party from seeking urgent relief, filing a complaint with a competent government agency, or exercising a legal right that cannot be waived.

Any court action shall be filed in the court with jurisdiction under applicable Philippine law. Nothing in these Terms limits the legally mandated venue or remedies available to a consumer.
